Desert Design Week - Ticket Sales Terms of Purchase

1. Acceptance of Terms
 By purchasing a ticket for Desert Design Week (the "Event"), organized by Desert Style Creative, LLC DBA Desert Style AZ (the "Organizer"), you (the "Attendee") expressly acknowledge and agree to be bound by these Ticket Sales Terms and Conditions (the "Terms"). These Terms constitute a legally binding agreement between the Organizer and the Attendee, and any violation of these Terms may result in legal action.

2. Ticket Purchase, Transfer, and Refund Policy
 2.1 Ticket Validity: Each ticket is issued for a single individual’s admission to the Event and is valid for one-time use only. Re-entry into the Event is strictly prohibited.
 2.2 Non-Refundable: All ticket sales are final. Under no circumstances shall tickets be refundable except in the event of the cancellation of the Event by the Organizer, in which case refunds shall be issued solely to the original purchaser.
 2.3 Transferability: Tickets are transferable, provided that the original purchaser furnishes the Organizer with the transferee’s full name and contact details prior to the commencement of the Event. The Organizer reserves the unilateral right to deny entry to any transferee who is not properly registered.
 2.4 Prohibition on Resale: Tickets may not be resold or otherwise offered for resale at a price exceeding the original purchase price. Any tickets found to be in violation of this provision may be declared void at the Organizer's sole discretion, without prior notice or refund.

3. Age Restrictions and Responsibilities
 3.1 No Age Restriction: The Event does not impose specific age restrictions. However, the Attendee shall be solely and fully responsible for their own conduct and the conduct of any minors in their custody or care while attending the Event, including any damage or injury caused by such minors.
 3.2 Supervision of Minors: The Attendee acknowledges and agrees that they are responsible for the supervision of any minors they bring to the Event. The Organizer shall bear no liability for any injury, loss, or damage incurred by or caused by minors at the Event.
 3.3 Alcohol Consumption: Only individuals aged 21 and over are permitted to purchase or consume alcohol at the Event. Valid government-issued identification is required for all alcohol sales. Attendees are responsible for their own responsibility regarding alcohol consumption and agree to indemnify and hold Desert Style Creative, LLC its employees, contractors, vendors, hosts, and other Attendees harmless for any claim, loss, liability, or damages caused by or proximate to Attendee’s alcohol consumption.

4. Accessibility
 4.1 The Organizer aims to make events open and accessible to all attendees. However, events held at private residences or other non-public venues may present challenges to accessibility. 

4.2 Accommodation Requests

Attendees requiring accommodations due to a disability should contact the Organizer at the email address below no less than 30 days prior to the event date to request needed accommodations. The Organizer will make every effort to collaborate with the venue host to make reasonable modifications to policies/practices and services to ensure effective the highest level of accessibility possible unless doing so would result in undue burden.,

 4.3.  Evaluation of Requests

The Organizer will engage in an interactive process with the attendee and the venue host to determine the appropriate accommodation based on the attendee's specific needs. The Organizer reserves the right to offer alternative accommodations and may deny requests that fundamentally alter the event or are unduly burdensome.

4.4 Limitations

The Organizer cannot guarantee the accessibility of the event venue and is not responsible for conditions outside of its control. Attendees accept potential risks associated with an event at a non-public venue. This provision shall be governed by U.S. Federal law.

5. Photography and Media
 5.2 Protection of Intellectual Property: All artworks, designs, and exhibits displayed at the Event are protected under applicable intellectual property laws. Any unauthorized use, reproduction, or distribution of images, designs, or content from the Event is strictly prohibited and will be prosecuted to the fullest extent permitted by law. Attendee agrees to properly credit Artists of any Artworks photographed, or distributed, such as on social media.

Attendees  acknowledge that photography, videography, and other recordings may take place. You hereby grant Desert Style Creative, LLC, its vendors, and event hosts the irrevocable right to use, reproduce, publish, distribute, and display your image, likeness, voice, and any other aspect of your participation in the event in any and all media, including but not limited to print, online, and social media, for any lawful purpose without compensation or notification.

Attendees understand and agree that these materials may be used for promotional purposes, advertising, and other lawful uses as determined by Desert Style Creative, LLC and its partners.

Additionally, you waive any rights to inspect or approve any finished product that may be used in connection with your likeness.

6. Health and Safety
 6.1 Health Guidelines: The Attendee acknowledges and agrees to refrain from attending the Event if exhibiting any symptoms of illness, including but not limited to fever, cough, or respiratory distress.
 6.2 Medical Assistance: Basic first aid services will be available at the Event. The Organizer shall not be held liable for any medical issues that require treatment beyond basic first aid. The Attendee shall be solely responsible for their own medical care and emergencies.
 6.3 Event Cancellation Due to Health Concerns: The Organizer reserves the right to cancel or reschedule the Event at its sole discretion due to public health concerns. In the event of such cancellation, refunds shall be issued solely in accordance with the Organizer’s refund policy.

7. Waivers and Release of Liability
 7.1 Assumption of Risk: The Attendee acknowledges that attending the Event involves inherent risks, including but not limited to physical injury, illness, or property damage. The Attendee voluntarily assumes all such risks.
 7.2 Release of Liability: The Attendee, on behalf of themselves, their heirs, assigns, and personal representatives, hereby irrevocably releases, discharges, and agrees to hold harmless the Organizer, its affiliates, agents, and the operators of the Event venues from any and all claims, liabilities, damages, or expenses arising out of or in connection with the Attendee’s participation in the Event.
 7.3 Indemnification: The Attendee agrees to indemnify, defend, and hold harmless the Organizer, its affiliates, and the operators of the Event venues from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to the Attendee’s participation in the Event or any breach of these Terms.

8. Third-Party Vendors
 8.1 Vendor Liability: The Organizer assumes no responsibility or liability for the actions, products, or services of third-party vendors. Any disputes arising from the Attendee’s interactions with third-party vendors shall be resolved directly between the Attendee and the vendor.

9. Privacy Policy
 9.1 Ticket Sales and RSVPs are conducted through our third party ticket sales sites via our website using Squarespace and Eventbrite. Your name and email address and phone number will be collected at the time of sales and held through our secure platform on FloDesk. Ticket sales and payments will be collected through Squarespace and Eventbrite. Please see these platforms secure payment information for terms regarding your payment information. We do not store or hold your payment information. Your payment information is secure and will not be used by us or any affiliates for any purpose other than your ticket purchase. 

Your name, email address, and phone number may be used by us, our affiliated companies, Desert Syle Creative, LLC, Desert Style AZ, Ruth Price, PLLC, and the event location hosts for marketing purposes. Your information will not be sold or distributed to any non-affiliated third party. 

10. Event Conduct
 10.1 Prohibited Items: The following items are strictly prohibited at the Event: weapons, illegal substances, hazardous materials, and any other items deemed dangerous by Event staff. Any prohibited items discovered will be confiscated, and the Attendee may be expelled from the Event without refund.
 10.2 Behavioral Expectations: The Attendee is expected to conduct themselves in a manner that is respectful of others at all times. The Organizer reserves the right to remove any Attendee engaging in disruptive, abusive, or unlawful behavior from the Event without refund.

11. Force Majeure
 11.1 Unforeseen Circumstances: The Organizer shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, civil unrest, government action, or pandemics. In such cases, the Organizer reserves the right to cancel, reschedule, or modify the Event without liability.

12. Severability
 12.1 Severability Clause: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary, so that the remaining provisions of these Terms shall remain in full force and effect.

13. Governing Law: These terms are governed by the laws of the state in which the Event is held. Any disputes arising from these terms or the Event shall be resolved in the courts of that state.
